Welcome to Wittd. These Terms of Service (the "Terms") govern your access to and use of Wittd and any related services, including our workspace collaboration tools, screenshot capture utilities, proxy browsing features, comment management system, integrations (such as Notion), and associated websites, dashboards, APIs, email notifications, or mobile experiences (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy.
You must be at least 18 years old and capable of entering into a legally binding agreement to use the Services. When you create an account, you agree to provide accurate, current, and complete information and to keep it up to date. You are responsible for maintaining the confidentiality of your login credentials, for all activities that occur under your account, and for notifying us promptly of any unauthorized use or security breach. Workspace owners and administrators are responsible for managing member access and ensuring compliance with these Terms.
Wittd offers free trials, paid subscriptions, and usage-based add-ons that may include limits on workspaces, projects, storage, comments, or automated captures. By subscribing to a paid plan, you authorize us (or our third-party payment processor, such as Stripe) to charge you all applicable fees in accordance with the selected plan and billing cycle. Fees are billed in advance, automatically renew until you cancel, and are final and non-refundable except where required by law. You can cancel your subscription at any time from your workspace billing settings, and your access will continue until the end of the current paid period. We may adjust pricing or plan features with reasonable advance notice.
You may downgrade or cancel your plan whenever you choose, and cancellation takes effect at the close of the current billing cycle. Because access continues through the period you have already paid for, we do not issue refunds or credits for partial months, unused features, downgrades, or account inactivity, unless required by applicable law. Please review plan details and renewal dates before confirming changes to avoid unexpected charges.
Between you and Wittd, you retain ownership of any content, comments, screenshots, project assets, URLs, or workspace data you upload or create within the Services (collectively, "Customer Content"). You grant Wittd a limited, worldwide, non-exclusive license to host, store, display, and process Customer Content solely for the purpose of providing and improving the Services. You represent that you have the necessary rights and permissions to submit Customer Content and that sharing it within Wittd does not violate any applicable laws, confidentiality obligations, or third-party rights.
You agree to use the Services responsibly and to comply with all applicable laws, including intellectual property, privacy, and data protection regulations. You will not (and will not permit others to): (a) misuse our proxy features to circumvent access controls or engage in unlawful monitoring; (b) upload malicious code, spam, or automated scripts; (c) attempt to interfere with or disrupt the integrity, security, or performance of the Services; (d) reverse engineer or copy any part of the Services; or (e) use the Services to collect or store sensitive personal information without appropriate consent. We reserve the right to investigate and disable accounts or workspaces involved in violations.
The Services may provide integrations with third-party platforms (including Notion) or allow you to access third-party websites through our proxy tooling. Your use of third-party services is governed by the applicable provider's terms, and Wittd is not responsible for third-party content, data handling, availability, or performance. We may transmit or receive data between Wittd and integrated services at your direction. You acknowledge that enabling an integration may grant a third party access to Customer Content and you are solely responsible for reviewing the relevant permissions.
We implement administrative, technical, and physical safeguards designed to protect Customer Content. However, no system is completely secure, and we cannot guarantee absolute security. You are responsible for configuring workspace settings, access controls, and retention policies that align with your compliance requirements. Our collection and use of personal data are described in our Privacy Policy. By using the Services, you consent to our data practices and to receiving service communications related to your account.
We aim to keep Wittd available and performant, but the Services may experience downtime, maintenance windows, or feature updates. We may modify, suspend, or discontinue any part of the Services at any time, with or without notice, provided that we will use reasonable efforts to notify paying customers of changes that materially reduce core functionality. Certain features, such as automated screenshot capture or proxy browsing, may depend on third-party infrastructure outside our control.
If you receive confidential information from Wittd (including non-public product roadmaps, pricing, or technical details), you agree to use it only in connection with the Services and to protect it from unauthorized disclosure. This obligation does not apply to information that becomes public through no fault of yours, was already lawfully known to you, or is independently developed without reference to Wittd's confidential information.
The Services are provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, or non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or immune from vulnerabilities, nor do we guarantee the accuracy of content captured from third-party websites. You acknowledge that comments, annotations, or external data may include inaccuracies introduced by users or source sites.
To the fullest extent permitted by law, Wittd and its affiliates, officers, employees, agents, suppliers, or licensors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, data, goodwill, or other intangible losses resulting from your use of or inability to use the Services. Our total liability for any claim arising out of or relating to these Terms or the Services is limited to the amount you paid to Wittd for the Services during the twelve (12) months preceding the event giving rise to the claim.
You agree to indemnify, defend, and hold harmless Wittd and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your Customer Content, your use of the Services, your violation of these Terms, or your infringement of any rights of a third party.
You may stop using the Services at any time by closing your account or cancelling your subscription. We reserve the right to suspend or terminate your access if you violate these Terms, cause harm to other users, or pose a security or legal risk. Upon termination, your right to access the Services will immediately cease, and we may delete Customer Content in accordance with our data retention policies, except as required by law. Sections that by their nature should survive will remain in effect, including ownership, confidentiality, indemnification, disclaimers, and limitations of liability.
These Terms are governed by the laws of the State of Delaware, excluding its conflict of law principles. Any disputes will be resolved in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts. If required by applicable law, we will engage in good faith informal resolution efforts before pursuing formal proceedings.
We may update these Terms from time to time to reflect changes in our Services, legal requirements, or business practices. When we make material changes, we will provide notice through the Services or by email before the new Terms take effect. Your continued use of the Services after the effective date constitutes acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Services and cancel your account.
